Wafer Painting Ltd - Client Agreement & Terms

Our Commitment to You: We want your painting project to be smooth, clear, and professional. These terms outline how we work together to ensure a great result for both of us. By accepting our quote, you agree to these terms

1. Getting Started: The Quote and Contract

  • The Quote: Our Quote details the exact work we’ll do and the price. It’s valid for 30 days.
  • The Agreement: Your acceptance (by signing, emailing, texting) confirms you agree to these terms, forming our contract.

2. Money Matters: Price and Payment

  • Pricing: All prices are in NZD and are exclusive of GST.
  • Progress Payments: For longer projects (over one month), we’ll send a bill each month for the work completed. This helps us keep the project moving.
  • Final Payment: The final bill is due immediately upon practical completion (when the painting is essentially done, even if a few minor touch-ups remain).
  • Late Payment: If payment is late, we may charge interest, stop work immediately, and recover any debt collection costs.

 3. Changes and Surprises (Variations)

  • Scope: We only paint what is itemised on your Quote.
  • Changes (Variations): If you want to change the job (e.g., add a room or change a colour), we must agree on the new price and timeline in writing before we proceed.
  • Hidden Issues: If we uncover anything unexpected (like rotten wood, serious water damage, or asbestos) that stops the painting, we’ll pause work and let you know. Fixing those issues is your responsibility, or we can agree on a new, written quote (Variation) to fix it ourselves.

Working Together: Safety and Preparation 

4.  Your Role in Site Safety (Health & Safety at Work Act 2015)

  • Clear Access: Please ensure we have clear, safe, and uninterrupted access to the work area during our working hours (typically 7:00 am – 5:30 pm, Mon-Fri).
  • Utilities: You agree to provide us with access to water, power, and toilet facilities free of charge.
  • Critical Safety Information: You must tell us about all known hazards on your property before we start (e.g., aggressive pets, unstable decking, or any hidden dangerous materials).
  • Restricted Areas: We will mark off certain work areas (Exclusion Zones) for safety (especially when using ladders or sprays). Please ensure children, pets, family members, or tenants stay out of these areas while we are working.
  • Your Preparation: Please remove all small, fragile, or valuable items (ornaments, electronics, etc.) from the workspace. We will handle moving large furniture. We will cover and protect flooring with dropsheets or similar.

 5.  Materials and Ownership

  • Quality Materials: We only use high-quality materials from reputable brands.
  • Materials Risk: Once our materials are delivered to your site, you are responsible for their safety. We are not liable for materials that are lost or stolen from your property.
  • Ownership: We legally own all paint and materials until you have paid your invoice in full.

After the Job: Guarantee and Liability

6. Our Guarantee & New Zealand Law

Workmanship Guarantee: We guarantee our workmanship for five (5) years] from the date we finish, provided all invoices are paid.

This covers issues caused by faulty preparation or application by our team.

What Our Guarantee DOES NOT Cover: Our guarantee cannot cover damage caused by things outside our control, such as:

  • Normal wear, tear, or fading.
  • Structural movement (cracks).
  • Severe weather damage.
  • Pre-existing issues like rising damp or existing rust.
  • NZ Law: Nothing in this agreement takes away your rights under the Consumer Guarantees Act 1993 (CGA).
  • Our Liability: We are responsible for the work we perform. We are not responsible for any indirect or secondary losses (like loss of business revenue while painting your commercial store) that may occur. Our total liability is limited to the value of your project.

7. Ending the Contract

  • Termination: If either of us seriously breaches this agreement (e.g., by failing to pay or failing to provide safe access) and doesn’t fix it within 14 days of written notice, the contract can be terminated.
  • Payment on Termination: If the contract ends early, you must still pay for all work completed and all materials used or ordered up to that date.

8. Governing Law

  • This contract is governed by the laws of New Zealand.
